1. Agreement to Terms

By accessing or using insta.lk, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. User Responsibilities

As a user of this free marketplace, you agree that you are solely responsible for the content of your advertisements. You must ensure that:

  • The items or services listed are legal to sell in Sri Lanka.
  • Your descriptions are accurate and not misleading.
  • You possess the right to sell the advertised items.
  • You will not post offensive, discriminatory, fraudulent, or inappropriate content.

3. Ad Duration and Expiration

To ensure our marketplace remains fresh and relevant for all users, all advertisements are published for a maximum duration of thirty (30) days. After 30 days from the date of publishing, your advertisement will be automatically removed from the platform. If your item remains unsold after this period, you are welcome to create a new listing.

4. The Platform as a Venue

insta.lk acts exclusively as a passive online venue for sellers to list items and buyers to find them. We are not involved in the actual transaction between buyers and sellers. We do not guarantee the existence, quality, safety, or legality of the items advertised; the truth or accuracy of users' content or listings; the ability of sellers to sell items; or the ability of buyers to pay for items.

5. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. insta.lk expressly disclaims all warranties of any kind, whether express or implied.

We make no warranty that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the service will be accurate or reliable.

6. Limitation of Liability

IN NO EVENT SHALL INSTA.LK, ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY:

  • Errors, mistakes, or inaccuracies of content.
  • Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services.
  • Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
  • Any interruption or cessation of transmission to or from our services.
  • Any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our services by any third party.
  • Transactions, interactions, or disputes between you and any other user of the platform.

7. Indemnification

You agree to defend, indemnify, and hold harmless insta.lk and its personnel from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms & Conditions.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your advertisement caused damage to a third party.

8. Content Removal & Account Termination

insta.lk reserves the right to remove any advertisement, or block any user, at our sole discretion and without notice, if we believe the user violates these terms, engages in fraudulent activity, or acts inappropriately.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law provisions.
